What is the NDAA and in what way does it affect me?

We are referring to the John S. McCain National Defense Authorization Act (NDAA) for Fiscal Year 2019.  In this specific Congressional act, there was a new section (sec. 889) entitled "Prohibition on certain telecommunications and video surveillance services or equipment".  This section as of August 2020 prevents the federal government from not only purchasing or extending a contract of prohibited equipment but allow states that the federal government will not continue to do business with any entity that “uses” any prohibited equipment within their own facility.  This means that regardless if you’re selling the government office equipment, performing repairs on a government facility, or simply running a laundry service, if you use any prohibited equipment at your own facility you are in violation of section 889.        

What is Section 889?

Section 889 was implemented in 2 phases called Sec. 889 (a)(1)(A) and Sec. 889 (a)(1)(B) that were rolled on Aug 13, 2019 and August 13, 2020 respectively.

Sec. 889(a)(1)(A) required the federal government to not “procure or obtain or extend or renew a contract to procure or obtain any equipment, system, or service that uses covered telecommunication equipment or services as a substantial or essential component of any system, or as critical technology as part of any system.”

Sec. 889(a)(1)(B) will prohibit the federal government from entering into or extending or renewing contracts with any entity that “uses any equipment, system, or service that uses covered telecommunication equipment or services as a substantial or essential component of any system, or as critical technology as part of any system.”

What can I do to comply?

In order to stay within compliance of the law, you cannot use any of the equipment manufactured by the companies above if you are going to continue to service the federal government.  We provide NDAA compliant products that not only are allowed to be sold to the federal government but are also excellent options for keeping the government contractor’s own facility in compliance.
